Terms, Conditions and Acceptable Use Policy

Terms of Service...

Blogomania provides internet worldwide web page hosting, shell accounts, and e-mail accounts services. Blogomania has certain legal and ethical responsibilities regarding the use of its computer network and equipment involved in these services. Blogomania general policy is to act as a neutral provider of access to the global Internet. All terms of conditions stated hereof are governed by the laws under the state of New York, USA. Blogomania reserves the right to suspend or cancel a customers’ access to any or all services provided by Blogomania when Blogomania decides that the account has been used inappropriately.

Specific Acceptable Use Policies...
There are to be no war, xdcc eggdrops or takeover bots ran here at Blogomania. You shall not run eggdrop bots on a server that doesn’t allow them. There shall be no denial of service ( DoS )attacks. If you are found using or participating in denial of service attacks you will have your account suspended immediately, pending an investigation by Blogomania management.

Use of our Servers...
Web sites and shell accounts are to be used by the primary owner only. Customers running CGI or other scripts that use up an unreasonable amount of CPU, memory, or load average will be immediately suspended. Furthermore no customer may use more than 20% of system resources at any give time. Customers are not permitted to resell, store, or give away web hosting services off of their web site to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.

Unauthorized Use of Other People's Accounts or Computers...
Blogomania will strongly react to any use or attempted use of an internet account or computer without the owner's authorization. Such attempts include tricking other people into releasing their passwords, password cracking, security hole scanning, etc. Any unauthorized use of accounts or computers by a Blogomania customer, whether or not the attacked account or computer belongs to Blogomania, will result in action against the attacker. Possible actions include warnings, account suspension or cancellation, and civil or criminal legal action, according to the seriousness of the attack.

Commercial Advertisements with E-mail - Spamming...
Unsolicited commercial advertisements are not allowed in e-mail, and will likely result in account suspension or cancellation. Commercial advertisements are unwelcome in most Usenet discussion groups and on most e-mail mailing lists. Inappropriate posting may result in account suspension or cancellation. See the newsgroup or mailing lists charter for whether advertising is allowed or not. Spamming, or sending a message to many different off-topic newsgroups, is particularly unethical and will be treated as such.

Payment Policies...
All accounts are set up on a pre-pay basis. Setup fees are charged for all new accounts and major accounts changes and are non-refundable. All pricing is guaranteed for the term of pre-payment. Blogomania reserves the right to change prices at any time. Payment is due each anniversary month or period following the date the account was established. Unless otherwise indicated, the amount owed will automatically be deducted from the credit card provided by the client at account activation. Blogomania must receive payment from customers paying by check or money order on the date of account renewal. Failure to do so will result in account cancellation. If a customer's check bounces, that customer is responsible for the fees owed, and a ten dollar returned item fee. The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies Blogomania to request termination of services. Failure of payment will result in account suspension or cancellation. The user will not be granted access to any data on the website until all outstanding balances are paid in full. All payment is in U.S. currency.

Cancellation...
Blogomania reserves the right to cancel service at any time. Blogomania can not be held responsible for any lost data, revenue, or business from this act. If cancellation is caused by customers’ violation of these policies, then no refund is due. Customers can cancel service any time but no refund is due. Informing Blogomania to cancel service, either by phone, email, fax, or an alternative method, does not constitute an actual cancellation of services. Cancellation must occur by filling out the form located on the Blogomania website. When customers cancel their account by Blogomania, the account will be deleted immediately. It is advised that the customer makes copies of all files needed, since once the account is deleted there is no way to retrieve them. Furthermore, if a customer cancels their account before the next billing period, Blogomania can not be held responsible for monies owed. Cancellation must occur at least one week prior to the next due date. Otherwise, the client will be billed at that time. Though a client might cancel their account, any overdue balances are still owed to Blogomania. Failure to pay Blogomania at the time of cancellation will cause this matter to be handed over to our collection agency.

Domain Names...
Customers may purchase new domain names at the time of account sign-up. It is the sole responsibility of the customer to ensure that the new domain name is available for purchase. If the customer places an order for a new domain name that is not available, that client will be billed the domain name registration fee. The client must contact Blogomania to purchase a new domain name, to be used instead of the pre-existing domain name. All .info and .biz domain names must be registered for a period of two years. Clients who wish to transfer a domain name to Blogomania are responsible for the domain transfer. Though Blogomania will assist in the transfer, it is the responsibility of the domain owner to make any necessary domain name changes. Please review the following policies before registering a domain name; gTLD Agreement , Domain Dispute Policy , .biz Agreement , .info Agreement.

Unlimited...
Blogomania offers unlimited email accounts, mailing list, auto-responders, etc. Customers may use as many items of these features as they want, inasmuch as the resources placed on the server by that customer does not exceed 15%. Blogomania reserves the right to suspend customers using 15% or more of system resources at any given time.

Lawful Purposes...
Blogomania reserves the right to refuse service to anyone. Customers may only use Blogomania server for lawful purpose. Transmission of any material in violation of any federal, state or local regulation is prohibited. This includes, but is not limited to copyrighted material, material legally judged to be threatening or obscene and material protected by trade secrets. Blogomania expressly forbids anyone from using Blogomania servers for the propagation, distribution, housing, processing, storing, or otherwise handling in any way lewd, obscene, and satanic materials. This includes sites that may infer sexual content or links to adult content elsewhere. The designation of any materials as such described above is left entirely to the discretion of the Blogomania management. Blogomania is intended for the end user only. Customers cannot sublease, subhost, or give away control of any portion of Blogomania resources. Doing so could result in immediate account cancellation.

Blogomania will not be responsible for any damages your business may suffer. Blogomania can not be held responsible for any lost data, databases, files, or any other items hosted by our web servers. Blogomania encourages all members to constantly make back-ups of your files. Blogomania makes no warranties of any kind, expressed or implied for services we provide. Blogomania disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Blogomania and its employees. Blogomania reserves the right to revise its policies at any time.
